1. Acceptance of Terms

These Terms and Conditions (hereinafter "Terms," "Agreement," or "Terms of Service") constitute a legally binding agreement between you (hereinafter "User," "Player," "You," or "Your") and phlogo (hereinafter "phlogo," "We," "Us," or "Our"), governing your access to and use of the phlogo online gaming platform, website, mobile applications, and all associated services (collectively, the "Platform" or "Services").

By creating an account with phlogo, accessing the Platform, depositing funds, placing wagers, or otherwise utilizing any Services provided by phlogo, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, including all policies incorporated herein by reference, such as our Privacy Policy, Responsible Gaming Policy, and Bonus Terms and Conditions. If you do not agree to these Terms, you must immediately discontinue use of the Platform and refrain from creating an account.

These Terms apply to all users of the phlogo Platform, including but not limited to registered account holders, visitors browsing the website, participants in promotional campaigns, and recipients of marketing communications. Your continued use of the Platform following any modifications to these Terms constitutes acceptance of such modifications, and you are therefore encouraged to review this Agreement periodically.

2. Eligibility Requirements

Online gambling is strictly prohibited for minors under Philippine law and PAGCOR regulations. By creating a phlogo account, you represent and warrant that you meet the minimum age requirement and possess the legal capacity to enter into binding contracts under Philippine law.

phlogo reserves the right to request proof of age at any time through government-issued identification documents. Failure to provide satisfactory age verification documentation within seven (7) calendar days of request may result in immediate account suspension and forfeiture of any funds or winnings. Any person found to have created an account while underage will have their account permanently closed, all deposits refunded (minus any winnings), and will be permanently banned from future Platform access.

2.2 Geographic Restrictions

The phlogo Platform is intended exclusively for users physically located within the Republic of the Philippines at the time of account access and gameplay. Users located in jurisdictions where online gambling is prohibited by law are expressly forbidden from using the Services. It is your sole responsibility to ensure that your use of phlogo complies with all applicable local, provincial, and national laws governing online gaming activities.

phlogo employs geolocation technology to verify user location. Attempts to circumvent geographic restrictions through virtual private networks (VPNs), proxy servers, or similar technologies constitute a material breach of these Terms and may result in immediate account closure and forfeiture of funds. phlogo disclaims any liability for users who access the Platform from restricted jurisdictions.

2.3 Account Capacity

Each individual person is permitted to maintain only one (1) active phlogo account. Creating multiple accounts, whether under the same name or using different personal information, constitutes fraudulent activity and is strictly prohibited. Users found operating duplicate accounts will have all accounts permanently closed, deposits forfeited, and winnings voided. phlogo reserves the right to pursue legal action against users engaging in multi-accounting fraud.

3. Account Registration and Security

3.1 Registration Process

To access the full functionality of the phlogo Platform, users must complete the account registration process by providing accurate, current, and complete information as requested in the registration form. Required information typically includes, but is not limited to: full legal name as it appears on government-issued identification, date of birth, residential address, valid email address, mobile telephone number, and preferred currency (PHP for Philippine users).

You represent and warrant that all information provided during registration and thereafter is truthful, accurate, and complete. phlogo reserves the right to verify any information submitted and to request supporting documentation, including government-issued identification, proof of address (utility bills, bank statements), and financial account verification. Providing false, misleading, or fraudulent information constitutes a material breach of these Terms and may result in immediate account termination and forfeiture of funds.

3.2 Account Security Obligations

You are solely responsible for maintaining the confidentiality of your phlogo account credentials, including your username and password. You must not share your login information with any third party under any circumstances. All activities conducted through your account, whether authorized by you or not, are your sole responsibility. You agree to immediately notify phlogo of any unauthorized access to your account or any other security breach.

phlogo recommends implementing strong password practices, including using unique passwords not shared with other online services, combining uppercase and lowercase letters with numbers and special characters, and changing passwords periodically. phlogo offers optional two-factor authentication (2FA) for enhanced account security, and users are strongly encouraged to enable this feature.

3.3 Account Verification (KYC Compliance)

In compliance with Philippine anti-money laundering regulations and PAGCOR requirements, phlogo maintains comprehensive Know Your Customer (KYC) procedures. Before processing certain transactions, particularly withdrawals exceeding specified thresholds or irregular deposit patterns, phlogo may require users to complete identity verification by submitting copies of valid government-issued identification documents (passport, driver's license, national ID card), proof of address dated within the last three (3) months, and potentially additional documentation at phlogo's discretion.

Withdrawal requests cannot be processed until satisfactory KYC documentation has been reviewed and approved by phlogo's compliance team. Processing times for document verification typically range from twenty-four (24) to seventy-two (72) hours, though complex cases may require additional time. Failure to provide requested KYC documentation within fourteen (14) calendar days may result in account suspension.

4. Deposits, Withdrawals, and Financial Transactions

4.1 Deposits

phlogo accepts deposits through various payment methods including GCash, Maya (formerly PayMaya), bank transfers to designated Philippine banks (BPI, BDO, UnionBank, and others), and cryptocurrency (USDT) for eligible users. Minimum and maximum deposit amounts vary by payment method and are displayed during the deposit process. All deposits are processed in Philippine Pesos (PHP) unless otherwise specified for cryptocurrency transactions.

Deposited funds typically appear in user accounts within minutes for e-wallet transactions (GCash, Maya) or within one (1) to three (3) business days for bank transfers, depending on processing times of financial institutions. phlogo does not charge deposit fees, though payment processors or financial institutions may impose their own transaction charges. Users are responsible for any third-party fees associated with deposit transactions.

All funds deposited to your phlogo account must originate from payment sources registered in your own name. Third-party deposits are strictly prohibited as part of our anti-money laundering compliance. Deposits originating from sources not registered to the account holder will be returned to the sender, minus applicable transaction fees, and may result in account investigation or suspension.

4.2 Withdrawals

Users may request withdrawals of available account balances subject to fulfillment of all bonus wagering requirements and completion of identity verification procedures. Withdrawal requests must be made to payment methods registered in the account holder's name. The minimum withdrawal amount is PHP 500, and maximum withdrawal limits apply based on user verification status and account history.

Standard withdrawal processing times are as follows: GCash and Maya withdrawals typically process within five (5) to fifteen (15) minutes for verified accounts; bank transfers process within one (1) to three (3) business days; cryptocurrency withdrawals process within twenty-four (24) hours. phlogo reserves the right to request additional identity verification documentation before processing withdrawal requests, particularly for first-time withdrawals, large-amount withdrawals, or irregular withdrawal patterns. Withdrawals may be declined if account verification is incomplete, if bonus wagering requirements have not been met, if fraudulent activity is suspected, or if the withdrawal request violates any provision of these Terms.

4.3 Fees and Charges

phlogo does not charge fees for deposits or withdrawals. However, third-party payment processors, banks, or e-wallet providers may impose their own transaction fees, which are beyond phlogo's control and are the sole responsibility of the user. Users should review the fee structures of their chosen payment methods before initiating transactions.

4.4 Currency and Exchange Rates

All financial transactions on the phlogo Platform are conducted in Philippine Pesos (PHP) unless cryptocurrency options are utilized. For cryptocurrency deposits and withdrawals, exchange rates are determined at the time of transaction based on prevailing market rates. phlogo is not responsible for fluctuations in cryptocurrency values between deposit and withdrawal.

5. Bonus Terms and Promotional Offers

5.1 General Bonus Provisions

phlogo periodically offers promotional bonuses, free spins, cashback rewards, and other incentives to users (collectively, "Bonuses"). All Bonuses are subject to specific terms and conditions that supplement these general Terms. Bonus-specific terms are provided at the time of offer and must be reviewed carefully before accepting any promotional offer.

Unless otherwise specified, all Bonuses are subject to wagering requirements before associated winnings may be withdrawn. Wagering requirements specify the number of times bonus funds must be wagered before conversion to withdrawable cash. For example, a PHP 1,000 bonus with a 30x wagering requirement must be wagered PHP 30,000 (1,000 × 30) before withdrawal is permitted. Wagering requirements vary by promotion and game type, with different games contributing different percentages toward requirement fulfillment.

5.2 Bonus Eligibility and Restrictions

Bonuses are available only to eligible users who meet specified criteria, which may include account verification status, deposit history, gameplay patterns, or geographic location. Certain payment methods may be excluded from bonus eligibility, and users should review payment-specific terms before depositing with intent to claim promotional offers.

5.3 Wagering Contributions

Different game categories contribute varying percentages toward bonus wagering requirement fulfillment. Typical contribution rates are as follows: slot games contribute 100%; table games (blackjack, roulette, baccarat) contribute 10-20%; video poker contributes 10%; live dealer games contribute 10%; progressive jackpot slots may contribute 0% or reduced percentages. 6.2 Prohibited Betting Patterns

Certain betting strategies are prohibited when used in conjunction with active bonuses or promotional funds. These include but are not limited to: low-risk betting (e.g., covering multiple outcomes in roulette to guarantee wins); delayed round gaming (completing game rounds after bonus conditions end); martingale or similar progression systems designed to exploit bonus funds; simultaneous opposite betting across multiple accounts or with other players; any strategy primarily designed to convert bonus funds to cash with minimal risk rather than engaging in genuine gameplay.

Users must not attempt to: reverse engineer, decompile, or disassemble Platform software; access restricted areas of the Platform through hacking or unauthorized means; introduce viruses, malware, or malicious code; interfere with Platform operation or other users' access; scrape, crawl, or systematically extract data from the Platform; employ VPNs or proxy servers to circumvent geographic restrictions; manipulate or falsify geolocation data.

7. Intellectual Property Rights

All content, software, designs, graphics, logos, trademarks, service marks, images, text, audio, video, and other materials displayed on or accessible through the phlogo Platform (collectively, "Content") are the exclusive property of phlogo or its licensors and are protected by Philippine and international intellectual property laws, including copyright, trademark, and trade secret laws.

The phlogo name, logo, and all related product and service names, design marks, and slogans are trademarks or registered trademarks of phlogo. You are granted no right or license to use any such marks without the express written permission of phlogo. Third-party trademarks, including game provider names and logos, remain the property of their respective owners.

Subject to your compliance with these Terms, phlogo grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform solely for personal, non-commercial entertainment purposes. This license does not include any rights to: reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform; modify, adapt, translate, or create derivative works based on Platform content; distribute, transmit, broadcast, or make available Platform materials to third parties; remove or alter any copyright, trademark, or proprietary notices.

Unauthorized use of Platform content may violate copyright law, trademark law, privacy and publicity laws, and other applicable regulations. Any unauthorized use automatically terminates the license granted herein and may subject you to civil and criminal penalties.

8. Limitation of Liability and Disclaimers

8.1 Service Availability

While phlogo strives to maintain continuous Platform availability, we do not guarantee uninterrupted or error-free operation. The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

phlogo reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice, for any reason including but not limited to: scheduled maintenance, emergency repairs, technical issues, regulatory changes, or business decisions. phlogo shall not be liable for any interruption of services or inability to access the Platform.

8.2 Game Malfunctions

In the event of a game malfunction, including but not limited to software errors, network disruptions, display errors, or calculation mistakes, all affected bets and payouts are void and will be refunded. Users must report suspected game malfunctions immediately upon occurrence. phlogo's decision regarding game malfunction disputes is final and binding.

8.3 Limitation of Damages

To the maximum extent permitted by Philippine law, phlogo, its affiliates, directors, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage, system failure, or cost of substitute services, arising out of or in connection with these Terms or your use of or inability to use the Platform, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if phlogo has been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, phlogo's liability shall be limited to the maximum extent permitted by law. In no event shall phlogo's total aggregate liability to you for all damages, losses, and causes of action exceed the amount paid by you to phlogo in the three (3) months preceding the event giving rise to liability, or PHP 10,000, whichever is less.

8.4 Third-Party Services

The Platform may contain links to third-party websites, services, or content not owned or controlled by phlogo, including payment processors, game providers, and external resources. phlogo has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that phlogo shall not be responsible or liable for any damage or loss caused by or in connection with use of any third-party services.

9. Dispute Resolution and Governing Law

9.1 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts located in Metro Manila, Philippines, and you hereby consent to the personal jurisdiction and venue of such courts.

9.2 Dispute Resolution Process

Before initiating formal legal proceedings, you agree to first attempt to resolve any dispute through phlogo's internal complaint process. To initiate a complaint, contact phlogo customer support via email or live chat with a detailed description of your dispute. phlogo will investigate your complaint and respond within fifteen (15) business days. If the dispute cannot be resolved through customer support, you may escalate to phlogo's management team for further review.

9.3 Arbitration Agreement

Any dispute that cannot be resolved through phlogo's internal complaint process shall be resolved through binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center (PDRC) or similar recognized arbitration body. The arbitration shall be conducted in Metro Manila, Philippines, in the English language. Each party shall bear its own costs of arbitration, and the arbitrator's decision shall be final and binding upon the parties.

You agree that any arbitration shall be conducted on an individual basis and not as a class action, and you waive any right to participate in class action lawsuits or class-wide arbitration against phlogo.

9.4 Exceptions to Arbitration

Notwithstanding the arbitration provision above, either party may seek injunctive or equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.

10. Modifications and Termination

10.1 Modification of Terms

phlogo reserves the right to modify, amend, or update these Terms at any time at its sole discretion. Material changes will be notified to users through email, Platform notifications, or prominent notice on the website. Your continued use of the Platform following notice of modifications constitutes acceptance of the revised Terms. If you do not agree to modified Terms, you must discontinue Platform use and close your account.

The most current version of these Terms will always be accessible on the phlogo website with the effective date clearly indicated. Users are encouraged to review these Terms periodically to stay informed of any changes.

10.2 Account Termination by User

You may close your phlogo account at any time by contacting customer support and requesting account closure. Upon receiving your closure request, phlogo will process any pending withdrawals of available balance (subject to completion of wagering requirements and identity verification) and permanently deactivate your account. Terminated accounts cannot be reactivated; users wishing to return must create new accounts subject to these Terms.

10.3 Account Termination by phlogo

phlogo reserves the right to suspend or terminate your account immediately, with or without notice, for any reason including but not limited to: violation of these Terms; fraudulent activity; provision of false information; payment disputes or chargebacks; abuse of bonuses or promotional offers; irregular betting patterns; account inactivity exceeding twelve (12) months; legal or regulatory requirements; business decisions.

Upon account termination by phlogo, we will refund any remaining genuine balance (excluding bonus funds and winnings derived from Terms violations) to your registered payment method, subject to completion of verification procedures. phlogo reserves the right to withhold funds pending investigation of suspected fraudulent activity and may forfeit balances associated with Terms violations.

10.4 Survival

Provisions of these Terms which by their nature should survive termination shall survive, including but not limited to: intellectual property provisions, limitation of liability, indemnification obligations, dispute resolution procedures, and any outstanding financial obligations.
